WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

In consideration of Ride Chicago furnishing services and or equipment to enable me to participate in the Motorcycle Training program, I agree as follows;

I fully understand and acknowledge that (a) Risks and dangers exist in my use of motorcycles and motorcycle equipment in this training course. (b) My participation in such activities and or using the equipment may result in injury or illness including without limitation, bodily injury, disease, strains, fractures, partial and or total paralysis, death or other ailments that could cause serious disability. (c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of Ride-Chicago, Ride Chicago inc herein known as Ride Chicago; including instructors, teachers, property owners, negligence of the participants, negligence of other participants, accidents, breaches of contract, the forces of nature and or other causes and that these risks and dangers may arise from foreseeable or unforeseeable causes and ; (d) by my participation in these activities and or use of equipment, I hereby expressly assume all risks and dangers and all responsibility for any losses and or damages, whether cause in whole or in part by the negligence or other conduct of the owners, agents, officers, or employees of Ride-Chicago including instructors landowners or any other persons. I on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive discharge, hold harmless, defend and indemnify Ride-Chicago and its owners, agents, officers, employees, instructors, landowners, sanctioning organizations, sponsors, owners, facility owners, insurers, underwriters, consultants, or other persons or entities who give direction, instructions, evaluation regarding the premises or events held. from any and all claims, suits or causes of action for bodily injury, property damage wrongful death, loss of services or otherwise which may arise out of my use of motorcycles and motorcycle equipment and or my participation in the Ride Chicago classes, instruction or any activity relating to ride Chicago. I specifically understand and agree that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future for negligent acts or other conduct by Ride - Chicago and it's owners, agents , officers, employees , coaches, instructors, or property owners.

I HAVE READ THE ABOVE WAIVER AND RELEASE, AND BY ACKNOWLEDGING I AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE RIDE-CHICAGO AND IT'S FACILITY PARTNERS OR LANDLORDS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE AND OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE

Cancellations

The $95 course reservation fee is non-refundable. All cancellations must be made by email at least seven (7) days before the beginning of the session. Individuals who do not cancel prior to the seven-day period will be charged the balance of tuition. Students who wish to transfer sessions can have their deposit applied to another class provided they make arrangements at least seven days before the session they are registered for begins.

Attendance

Attendance at all classes is Mandatory to complete the course. All sessions begin promptly; being late will result in disqualification from the class. Students who are aware of a conflict can make arrangements to attend a different session by contacting Ride Chicago in advance.

Safety

In the interest of safety, Ride Chicago reserves the right to remove anyone who presents a hazard to themselves or others.

Postponement

Ride Chicago reserves the right to reschedule classes as necessary in response to inclement weather or other unforeseen circumstances. Students will be advised of any class postponements.

Disclaimer

Ride Chicago provides its services on an " as is " basis and makes no warranties of any kind with respect to them. Ride Chicago disclaims all such representations warranties and guarantees, whether express or implied but not limited to, the warranties of merchantability and fitness for a particular purpose

Registration

Ride Chicago at its sole discretion can accept or deny registration.

Terms subject to change

Ride Chicago reserves the right to change or modify the terms and conditions applicable to the use of its services at any time. Such changes modifications, additions or deletions to such terms and conditions shall be effective immediately upon notice thereof, which may be given by any means including, but not limited to, posting a notice on the ride Chicago website. Any use of ride Chicago services after such notice shall be deemed to constitute acceptance by you of such changes, modifications, additions, or deletions.
